Supreme Court Opposes Obama's Law-Breaking

The Supreme Court blocked Chrysler's sale to Fiat.

This is a positive development for two reasons:

1. It protects Chrysler's debtors from having their 5th amendment rights violated. The 5th Amendment states that no person can be "deprived of...property without due process of law". In other words, nobody can have their money taken unless they break a law. According to the Breitbart.com report:

As part of Chrysler's restructuring plan, the automaker's secured debt-holders will receive $2 billion, or about 29 cents on the dollar, for their combined $6.9 billion in debt.
The government is forcing the rightful owners of Chrysler, the bondholders, to take 29% of what their bonds are worth, and turning ownership over to the UAW. Did you catch that? The government is telling private investors to give 71% of what they have in the company to unions (which, and I'm sure this is just a coincidence, just happen to be overwhelmingly Democrat).

This is unlawful. The 5th Amendment protects this from happening. Had the Supreme Court not intervened would have been akin to partnering in the crime. If they do not uphold the debt-holders and rule against the UAW, they will be turning a blind eye to a colossal disregard of property rights.

2. It challenges to constitutionality of the bailouts: As Breitbart.com reports:
The funds also are challenging the constitutionality of the Treasury Department's use of money from the Troubled Asset Relief Program to supply Chrysler's bankruptcy protection financing. They say the government did so without congressional authority.
If the Treasury Department is found to be in violation of the constitution, it will set an important precedent that will hopefully rein in the Obama administration's socialist frenzy. It will by no means suffice, but it will be a step in the right direction.

The point is this: anyone who respects capitalism, the free market, and desires the constitution to be upheld and American freedom to be preserved, should pray to God that the court does the right thing, protects the interests of the shareholders, slaps the President's hand for his shameless favoritism toward liberal unions, and allows the failed corporation to die if necessary, so that the capitalist system can strengthen itself as it always does without government obstacles.

5th Amendment Right Violation

The administration's violation of principal American rights, namely the 5th Amendment, continue here...

For those of you who have yet to be enlightened by conservativism, the 5th Amendment prohibits government control of business: The 5th Amendment reads:

"No person shall...be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation"

Melbourne Florida Dealership 5th Amendment Right Stolen

Source: http://www.americanthinker.com/blog/2009/05/letter_from_a_dodge_dealer.html

Letter to the editor

My name is George C. Joseph. I am the sole owner of Sunshine Dodge-Isuzu, a family owned and operated business in Melbourne, Florida. My family bought and paid for this automobile franchise 35 years ago in 1974. I am the second generation to manage this business.

We currently employ 50+ people and before the economic slowdown we employed over 70 local people. We are active in the community and the local chamber of commerce. We deal with several dozen local vendors on a day to day basis and many more during a month. All depend on our business for part of their livelihood. We are financially strong with great respect in the market place and community. We have strong local presence and stability.

I work every day the store is open, nine to ten hours a day. I know most of our customers and all our employees. Sunshine Dodge is my life.

On Thursday, May 14, 2009 I was notified that my Dodge franchise, that we purchased, will be taken away from my family on June 9, 2009 without compensation and given to another dealer at no cost to them. My new vehicle inventory consists of 125 vehicles with a financed balance of 3 million dollars. This inventory becomes impossible to sell with no factory incentives beyond June 9, 2009. Without the Dodge franchise we can no longer sell a new Dodge as "new," nor will we be able to do any warranty service work. Additionally, my Dodge parts inventory, (approximately $300,000.) is virtually worthless without the ability to perform warranty service. There is no offer from Chrysler to buy back the vehicles or parts inventory.

Our facility was recently totally renovated at Chrysler's insistence, incurring a multi-million dollar debt in the form of a mortgage at Sun Trust Bank.

HOW IN THE UNITED STATES OF AMERICA CAN THIS HAPPEN?

THIS IS A PRIVATE BUSINESS NOT A GOVERNMENT ENTITY

This is beyond imagination! My business is being stolen from me through NO FAULT OF OUR OWN. We did NOTHING wrong.

This atrocity will most likely force my family into bankruptcy. This will also cause our 50+ employees to be unemployed. How will they provide for their families? This is a total economic disaster.

HOW CAN THIS HAPPEN IN A FREE MARKET ECONOMY IN THE UNITED STATES OF AMERICA?

I beseech your help, and look forward to your reply. Thank you.

Sincerely,

George C. Joseph
President & Owner
Sunshine Dodge-Isuzu

5th Amendment Right Stolen from Chrysler Dealer

Jim Anderer has seen his 5th Amendment rights violated by an administration that swore to uphold the Constitution. His Chrysler dealership was shut down. It was profitable, although that profitability is not the central issue. He issues the following charge:

"This is insanity. The government is stealing my business. Well, I cannot accept that as a patriotic American. I was raised in this country to believe that if I work hard and I achieve what I was going after -- and I did! I did it! I got it, and now all of a sudden because, you know, we have a president who pushes Chrysler into bankruptcy and puts all of the UAW workers out...? Didn't have to. Maybe some would have to go out but not all of them, okay. This doesn't happen in America. This is still America, I think. I mean, this isn't Stalinist Russia. This is not Nazi Germany where the troopers say you're out and their buddies are in. That's what I'm faced with."
The left wants to prosecute Bush for war crimes. Well here we have actual crime against an American businessman, a violation of the 5th Amendment, which reads:
"No person shall...be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."
The 5th Amendment protects individuals from having their property and business taken away from them without due process of law. In other words, the Constitution promises that you cannot have your business taken away except by consequence of having broken the law, and being found guilty according to the standards of the legal system.

Our administration, by virtue of asserting its authority in a Chrysler business decision, and forcing the closure of Chrysler dealerships, has failed its oath to uphold the Constitution, rendered itself an illegitimate authority in violation of the Supreme Law of our land, the Constitution, through which it derives its power to govern.

The moment at which the President fails to uphold the Constitution, is the moment he loses his mandate to govern, and the moment he becomes the greatest threat to American freedom and liberty that our law recognizes.
